A tiny part of legal practice is about supplying standard for legal documents. Believe us when we say that, contrary to popular belief, it is only a small part.

If you would like a document that you feel you could simply fill in without  advice, please let us know and we will quote you.

With any document we sell you, we will give you advice and suggestions as to what are important considerations. We would rather you buy these documents from us cheaply than you buy a document prepared by a paralegal or chancer that gives the legal profession an undeserved bad name.

The Structure of Documents

 

Standard Form Documents

These are documents such as the formation of a Close Corporation or a Company. The SOLE purpose is the record existing information as a fact.

 

Non Standard Documents.

All documents require certain factual information. eg Name; Rental; Duration. Some documents have a large component of "standardness" and some only a small component.

Mainly standard documents get that way because large numbers of people and transactions have similar interests. EG A least is largely standard because the LANDLORD has the control and he determines most of what goes into the contract. If the tenant wants to change it, one has to make careful amendments.

A document that requires more variability is for example a divorce agreement.  Certain things are standard because of the purpose is standard. Other things depend on what the parties agree. It is obvious that because each party should have equally power to decide on terms certain issues take a great deal of debate and careful recording once the parties are on the same path. Eg Maintenance or the sale of fixed property.

It is folly to think that just because both parties agree to sell the house in a divorce that is all that need be said. "Sell the House" That's it. .... Then what happens is one party stays there for years and other says, well you didn't say when. Or for how much. OR MORE IMPORTANTLY, what happens if we cant sell the house.

The lesson one does not want to learn is that you can save R500 on the legal document have a problems that costs you R100 000,00

A client, an engineer, sold his farm. It was in a company. He thought he would be clever and write the agreement him self based on a copied document. The effect of what he wrote was that the purchaser bought his shares for one Rand and paid the purchase to the company on loan.  Our client banked his R1,00 and the purchaser sold the property out of the company, took all the money.

His conclusion: The law and lawyers are at fault.

Our problems:

  1. You are bound by what you sign. 

  2. When you draw your own agreement, you are presumed to be aware of what you are writing.
